Reformasi Regulasi Pusat-Daerah

Malang, 17 November 2014 bertempat diruang Auditorium Lantai VI Fakultas Hukum Universitas Brawijaya diselenggarakan Seminar Nasional dengan tema, “Reformasi Regulasi Untuk Mewujudkan Sistem Regulasi Nasional Yang Sederhana Dan Tertib”. Kegiatan ini terselenggara atas kerjasama Kementerian PPN/BAPPENAS dan PPOTODA Universitas Brawijaya. Dalam sambutannya Dr. Diani Sadiawati SH, LLM

selaku Direktur Analisa Perundang-Undangan BAPPENAS memaparkan bahwa keluhan banyak pihak mengenai tidak hadirnya kepastian hukum dalam berbagai kesempatan sudah sering kali terungkap dalam pemberitaan.

Pihak yang mengeluhkan tersebut tidak hanya masyarakat kecil pencari keadilan tetapi juga para pelaku ekonomi berskala besar yang tidak merasa aman ketika melakukan investasi di Indonesia.Absennya kepastian hukum bisa didekati melalui 2 (dua) perspektif. Pertama, perspektif regulasi, yang ditandai dengan pengelolaan regulasi yang memprihatinkan sehingga menghasilkan regulasi yang berkualitas rendah dan kuantitas regulasi yang tidak proporsional.

Kedua, perspektif implementasi dan penegakan, yang antara lain tercermin dari rendahnya apresiasi masyarakat terhadap institusi penegakan hukum.Dalam pengantar diskusi Ngesti D. Prasetyo mengungkapkan bahwa Secara umum permasalahan regulasi yang dapat dirasakan langsung oleh masyarakat meliputi kualitas dan kuantitas regulasi yang tidak terkelola dengan baik sehingga akhirnya tidak berfungsi sebagai pedoman perilaku bahkan menjadi hambatan bagi terselenggaranya dinamika sosial, ekonomi, politik dan juga dalam penyelenggaraan Negara serta pembangunan.

Kualitas regulasi yang rendah ditandai dengan terjadinya tumpang tindih, multitafsir, potensi konflik, ketidaksesuaian asas, inkonsisten diantara regulasi dan banyaknya pengajuan judicial review oleh masyarakat terhadap Undang Undang meskipun UU tersebut baru saja disahkan. Sedangkan kuantitas regulasi tercermin dari banyaknya jumlah produksi regulasi baik pada tingkat pusat maupun tingkat daerah tanpa mengindahkan pentingnya menjaga proporsi regulasi.

Menyambung pemaparan tersebut Dr. Saiful Johan mengungkapkan bahwa Kegagalan mengelola regulasi secara baik berdampak besar terhadap semua aktifitas masyarakat termasuk penyelenggaraan Negara dan pembangunan.

Salah satu dampak yang paling signifikan dari kondisi regulasi di Indonesia yang kurang kondusif tersebut yaitu menurunnya daya saing Indonesia akibat sulitnya memulai usaha atau berinvestasi di Indoneia. Pada tahun 2011, The Worldwide Governance Indicators (WGI)memberikan skor 0,33 (minus nol koma tiga puluh tiga) kepada Pemerintah Indonesia terkait dengan tingkat kualitas regulasi di Indonesia dan memposisikan Indonesia dalam ranking (peringkat dalam presentase) 41,7 yang berarti bahwa kondisi regulasi di Indonesia masih kurang kondusif dan berada di bawah Malaysia (74,4), Thailand (56,4) dan Filipina (43,6).

Pada tahun 2011, Global Competitiveness Report memberikan skor 3,57 kepada Pemerintah Indonesia terkait dengan Burden of Government Regulation di bawah Singapura (5,56), Malaysia (4,43), Brunei Darussalam (3,76) dan Kamboja (3,65).

Dengan kondisi tersebut seharusnya pemerintah lebih memperhatikan permasalahan regulasi yang ada saat ini sebagai hulu dari permasalahan terhambatnya perekonomian di Indonesia sehingga upaya-upaya sistemik perlu disusun dalam rangka memperbaiki kondisi regulasi di Indonesia dengan menentukan tujuan yang jelas yaitu mewujudkan pembangunan nasional sehingga terciptanya peningkatan ekonomi dan kesejahteraan masyarakat Indonesia.

Selain itu, permasalahan regulasi dari segi kuantitas dan kualitas diindikasikan dengan banyaknya Perkara Pengujian Undang-undangpada Mahkamah Konstitusi RI dalam kurun waktu 2003-2008dan 2010-2014 terhadap 680 Undang Undang dan 157 diantaranya dikabulkan oleh Mahkamah Konstitusi.

Di tingkat daerah, seiring dengan lahirnya otonomi daerah melalui Undang Undang Nomor 22 Tahun 1999 Tentang Pemerintahan Daerah yang kemudian diganti dengan Undang Undang Nomor 32 Tahun 2004 Tentang Pemerintahan Daerah, pembentukan peraturan perundang-undangan di daerah menjadi tidak terkendali yang pada akhirnya menimbulkan permasalahan sehingga harus dibatalkan oleh pemerintah. Dalam kurun waktu tahun 2002 hingga tahun 2009 Kementerian Dalam Negeri telah membatalkan 1.878 Perda dan dari pembatalan tersebut jelas menunjukkan bahwa kondisi regulasi yang ada di daerah tidak jauh lebih baik dari kondisi regulasi yang ada di tingkat pusat.

Presiden dalam beberapa kali kesempatan juga telah menginstruksikan jajaran pemerintah, khususnya pemerintah daerah untuk memperbaiki birokrasi perizinan usaha di daerah masing-masing guna peningkatan investasi di Indonesia sehingga alasan untuk segera memperbaiki regulasi di Indonesia semakin jelas.

Kegiatan Seminar ini bertujuan (1) Memberikan pemahaman kepada semua warga masyarakat terutama komunitas yang berkepentingan dengan kebijakan dan regulasi (misalnya birokrat atau perguruan tinggi) mengenai pentingnya membangun dan mengelola sistem regulasi nasional di dalam suatu wadah Negara kesatuan. (2) Mengajak semua warga masyarakat terutama komunitas yang berkepentingan dengan kebijakan dan regulasi untuk berperan serta dan berkontribusi dalam mewujudkan sistem regulasi nasional yang sederhana dan tertib, karena pada dasarnya regulasi tidak hanya sekedar dasar hukum sebuah tindakan, tetapi juga panduan perilaku, instrumen pembangunan dan faktor integrasi dalam penyelenggaraan Negara. (3) Mendorong lahirnya agen perubahan untuk mempercepat penyelenggaraan reformasi regulasi pada semua lini, sektor dan wilayah sehingga sistem regulasi nasional lebih mampu mengatur dinamika secara lebih efektif dan efisien. (4) Membuka dan menampung masukan dari semua warga masyarakat dalam rangka penyempurnaan konsep Reformasi Regulasi yang Sistematis.
