FGD PPOTODA FH UB : Prosedur Perizinan Pendirian Rumah Ibadah

Pusat Pengembangan Otonomi Daerah dan Demokrasi (PPOTODA) Fakultas Hukum (FH) Universitas Brawijaya (UB) menyelenggarakan Focus Group Discussion (FGD), Kamis (11/10). Tema yang diangkat dalam diskusi ini adalah “Prosedur Perizinan Pendirian Rumah Ibadah”. Acara ini dipusatkan di Gedung Munir Lantai 2 FHUB.
Narasumber yang hadir dalam FGD ini adalah Dr. Ali Syafaat (Perwakilan Akademisi), Sapto Wibowo, SH., M.Hum (Bagian Hukum Pemerintah Kota Malang), Tony N (Badan Kesatuan Bangsa dan Politik Kota Malang), Harman (Bagian Hukum Pemerintah Kabupaten Malang), Drs. Heriyono (Kasubid Ketahanan Seni Budaya, Agama dan Kemayarakatan Badan Kesatuan Bangsa dan Politik Kabupaten Malang), Charles (Mahasiswa Pascasarjana FHUB), dan Yeli (Perwakilan Tokoh Gereja).
Menurut Dr. Ali Syafaat, kebebasan beragama di Indonesia merupakan Hak Asasi Manusia yang dijamin dalam Pasal 29 Ayat (2) UUD 1945. Demikian pula dalam hal pendirian rumah ibadah. “Menurut saya, aspek sosiologis itu menjadi aspek terpenting, ketika ada aspek lain, misal apabila ada kelompok masyarakat yang melakukan penolakan, maka perlu ada formula-formula yang harus dipikirkan, termasuk peran pemerintah untuk mengatur pendirian rumah ibadah, tentu tidak termasuk untuk membatasi,” ungkapnya.
Harman menanggapi, pendirian rumah ibadah harus ada syarat yang harus dipenuhi dan sudah diatur oleh peraturan, seperti Peraturan Bersama Menteri Agama dan Menteri Dalam Negeri (PB2M) Nomor 8 dan 9 Tahun 2006. Mekanisme yang diatur dalam PB2M tersebut mensyaratkan adanya syarat administratif dan teknis dalam pendirian rumah ibadah. “Harus ada izin tetangga, walaupun itu sudah dijamin oleh negara, kalau tidak memenuhi syarat maka tidak bisa,” paparnya.
Pemerintah menganggap untuk mendukung kerukunan umat beragama perlu wadah, sehingga pemerintah menyarankan mengumpulkan tokoh-tokoh agama dalam satu wadah komunikasi. Terbentuklan Lembaga Forum Komunikasi Umat Beragama (FKUB) yang terdiri dari gabungan tokoh-tokoh beragama. “Harapannya yang menjadi tokoh yang tergabung dalam FKUB tidak sekedar yang diamanatkan Konstitusi tetapi bangunan komunikasi dan solidaritas, dengan adanya lembaga ini akan menjembatani komunikasi umat berugama,” kata Tony.
Sebagai kesimpulan dari diskusi ini, Dr. Ali menyampaikan bahwa perspektif dari sisi HAM tidak boleh melanggar HAM yang lain juga. “Aturan dan regulasi sebaik apa pun untuk mengatur HAM tidak akan bisa dilaksanakan jika tidak ada toleransi yang baik dari para pemeluk agama,” katanya. Ia berharap agar dalam proses perijinan pendirian rumah ibadah dapat diikuti sesuai prosedur yang benar dan tidak direkayasa. “Selain itu peningkatan pemahaman toleransi pada semua umat beragama harus dikembangkan lagi sehingga regulasi bisa dijalankan dengan baik,” ungkapnya. “Pemerintah sebagai fasilitator atau pelayan masyarakat melalui bina desa, sosialisasi, FKUB, diharapkan dapat meningkatkan pemahaman masyarakat mengenai toleransi umat beragama,” pungkasnya.
