Sengkarut Tata Ruang

Rabu 31 Oktober 2012 Bertempat Di Auditorium Lantai VI Fakultas Hukum Universitas Brawijaya Malang diselenggarakan Seminar Nasional dengan tema, “Harmonisasi Hukum Peraturan Perundang-Undangan Bidang Penataan Ruang Sebagai Sarana Mewujudkan Sinkronisasi dan Sinergitas Penataan Ruang Pusat dan Daerah”.

Kegiatan ini terselenggara atas kerjasama Dewan Perwakilan Rakyat Daerah (DPD-RI) dan Pusat Pengembangan Otonomi Daerah (PP OTODA) Fakultas Hukum Universitas Brawijaya.(participatory democracy) yang berkembang menuju terwujudnya tata kelola pemerintahan daerah yang baik (good local governance) di berbagai bidang.

Dalam konteks tersebut maka salah satu isu hukum (legal issue) yang memiliki peran strategis dalam kaitannya dengan urusan wajib yang menjadi kewenangan Pemerintahan daerah di tingkat provinsi, kabupaten/kota yang sekaligus harus mendapatkan perhatian serius adalah dalam aspek penyelenggaraan pemerintahan di bidang penataan ruang.

Dalam Sambutannya Direktur Eksekutif PP OTODA Universitas Brawijaya Ngesti D. Prasetyo mengungkapkan bahwa Berdasarkan hasil penelitian PP OTODA dalam kurun waktu 2009-2012 di berbagai wilayah (Provinsi Kalimantan Timur, Provinsi Bali, Provinsi Jawa Tengah, dan Provinsi Jawa Timur) menunjukkan bahwa  perkembangan otonomi daerah tidak hanya di dominasi oleh penguasaan di sektor APBD maupun korupsi kepala daerah akan tetapi telah berkembang pada penguasaan-penguasaan berbagai sektor ruang dan pemberian izin yang sarat dengan manipulasi.

Hal senada juga disampaikan oleh Herry Yuherman selaku Kepala Pusat Kajian Daerah (PUSKADA) DPD-RI yang memparkan bahwa dengan pertumbuhan penduduk dan laju ekonomi telah mendorong pertumbuhan investasi yang bermotif keuntungan yang cenderung mengindahkan proses pemanfataan ruang yang partisipatif dan bertanggung jawab.

Problematika makro kebijakan penataan ruang pada skala nasional dan lokal diangkat sebagai bentuk keprihatinan terhadap tumpang-tindih, maupun sengkarut dalam proses perencanaan, pemanfaatan, maupun pengendalian ruang yang tidak singkron serta sinergis antara kebijakan pemerintah pusat dan daerah. Alasan ini bukanlah asusmi semata tanpa suatu alasan yang jelas.

Kegiatan yang berlangung selama satu hari ini di dahului dengan adanya penelitian baik baik secara normatif maupun empiris terhadap penyelenggaraan penataan ruang di Provinsi Kalimantan Timur, Provinsi Bali, dan Provinsi Jawa Tengah banyak temuan yang di potret dilapangan terkait dengan inkonsistensi kebijakan makro maupun mikro dalam penggunaan ruang baik di darat maupun di laut.

Problematika yang timbul sebagaimana dimaksud hadir dalam bentuk inkonsistensi peraturan perundang-undangan baik secara vertikal maupun secara horisontal untuk lebih spesifik tumpang tindih sebagaimana dimaksud nampak pada kasus, sengketa di bidang perizinan di sektor pertambangan, investasi di kawasan konservasi sebagaimana terjadi di kawasan karst pegunungan kendeng, pembangunan PLTU Ujungnegoro, investasi pertambangan di Kalimantan Timur, pelanggaran sempadan pantai bagi pembangunan resort dan hotel di kawasan Kabupaten Badung Bali, dan berbagai kompleksitas penataan ruang yang dalam kondisi kekinian di pengaruhi juga oleh faktor percepatan pembangunan ekonomi sebagaimana amanat Master Plan Perencanaan Percepatan Pembangunan Ekonomi Indonesia (MP3EI) dengan indikator makro pembangunan infrastruktur di berbagai bidang.

Pada sisi yang lain di tengah tuntutan globalisasi dan modernisasi secara kuantitas masih banyak Provinsi, Kabupaten/Kota di Indonesia yang belum merampungkan pembentukan Perda RTRW sebagaimana amanat ketentuan UU No 26 Tahun 2007 tentang Penataan Ruang.

Adapun faktor dominan yang sering menghinggapi dalam penataan ruang juga disebabkan oleh ketertutupan informasi, minimnya partisipasi masyarakat dan kuatnya paradigma birokrasi yang menganggap bahwa investasi tidak boleh terhalang oleh adminstrasi.

Kedepan penguatan terhadap penataang ruang pusat dan daerah di perlukan suatu upaya yang serius untuk menegakkan hukum dan memperkuat peran serta masyarakat pada derajat yang equal (kesetaraan) melalui keterlibatan unsur masyarakat dalam institusi khusus bidang penataan ruang.

Dalam kegiatan tersebut dibuka langsung oleh Dekan Fakultas Hukum Universitas Brawijaya Dr. Sihabudin SH, MH yang dihadiri oleh 250 peserta antara lain Dr. Ibnu Tricahyo SH, MH (Ombudsman RI), Dr. Ir. Ibnu Sasongko M.Si, Sekretariat Jenderal DPD, RI, selaku narasumber Kepala Biro Persidangan DPD-RI, Kementerian PU, Akademisi (Hukum, FISIP, Ekonomi dan Bisnis, FIA, Plannologi), Bagian Hukum Kabupaten/Kota se Jawa Timur, DPRD Se Jawa Timur, Dinas PU, Dinas ESDM, Bappeda Kabupaten/Kota Se Jawa Timur, Mahasiswa Program Doktor-Magister, LSM, dan pemerhati tata ruang-lingkungan hidup.
