Bertempat di Ruang Suro Adiningrat Pemerintah Kabupaten Jombang, Ngesti D. Prasetyo selaku Ketua PP OTODA menjadi narasumber dalam kegiatan Pembinaan Lembaga Keuangan Mikro (LKM) Keterkaitannya dengan Undang-Undang Nomor 1 Tahun 2013.Lembaga Keuangan Mikro (LKM) merupakan salah satu penggerak perekonomian dalam skala mikro sehingga upaya mendorong pemberdayaan masyarakat melalui lembaga keuangan non-bank telah tumbuh dan berkembang baik yang didirikan pemerintah maupun masyarakat.

Keberadaan LKM telah membuktikan beberapa manfaat yakni yang pertama LKM tumbuh dan berkembang di masyarakat serta melayani usaha mikro dan kecil (UKM), kedua diterima sebagai sumber pembiayaan anggotanya (UKM), ketiga mandiri dan mengakar di masyarakat, keempat jumlah cukup banyak dan penyebaran nya meluas, keempat dapat menjangkau (melayani) anggota dan masyarakat, kelima memiliki prosedur dan persyaratan peminjaman dana yang dapat dipenuhianggotanya (tanpa agunan), dan yang terakhir membantu memecahkan masalah kebutuhan dana yang selama ini tidak bisa dijangkau oleh kelompok miskin.

Sehingga dalam memberikan landasan hukum atas Lembaga Keuangan Mikro (LKM) maka pada tanggal 8 Januari 2013 telah diundangkan Undang-Undang Nomor 1 Tahun 2013 tentang Lembaga Keuangan Mikro.

Namun sejalan dengan tumbuhnya keberadaan LKM di tengah masyarakat saat ini masih belum memenuhi persyaratan yaitu berbentuk badan hukum, badan usaha, permodalan, dan mendapatkan izin usaha dari Otoritas Jasa Keuangan (OJK) baik dalam bentuk Koperasi atau Perseroan Terbatas (PT).

Dalam kegiatan Pembinaan LKM tersebut Ngesti memaparkan bahwa konstruksi hukum LKM harus memenuhi persyaratan bentuk badan hukum yakni Koperasi dan Perseroan Terbatas, jika LKM tidak mempunyai legalitas maka aktivitasnya dan operasional tidak dapat berjalan dengan lancar dan hasil dari kinerjanya pun pasti tidak akan maksimal.

Selain hal tersebut, berakibat pada perlindungan konsumen lemah, sehingga apabila terjadi sesuatu yang tidak diinginkan, pihak konsumen atau nasabah akan banyak dirugikan.” Berdasarkan hasil identifikasi awal, LKM yang berada di bawah binaan SKPD terkait belum memiliki badan hukum berdasarkan amanat Undang-Undang Nomor 1 Tahun 2013 tentang Lembaga Keuangan Mikro sehingga diharapkan kesinergitasan antara pelaku LKM dan SKPD di lingkup Kabupaten Jombang dalam melakukan pembinanaan serta mengarahkan LKM sesuai dengan amanat dari Undang-Undang Nomor 1 Tahun 2013 tentang Lembaga Keuangan Mikro.
