Berdasarkan KEPMEN ESDM No. 716.K/40/MEM/2003. Di Jawa Timur terdapat 23 CAT, terdiri dari 4 CAT Lintas Propinsi, 14 CAT Lintas Kab/Kota dan 5 CAT Tunggal. Selain dari pada itu pengawasan dan pengendalian belum optimal (tindakan terhadap pelanggar). Kesadaran Pengguna Air Tanah (kaya air tanah) serta data teknis dan sarana pemantauan belum Optimal.
Dalam pemaparannya disebuah Sosialisasi bertempat di Kota Mojokerto Tim Peneliti PPOTODA menyampaikan materi terkait dengan transformasi urusan penerbitan izin dalam konteks Pemanfaatan Air Tanah beralih dari Kabupaten/Kota menjadi kewenangan Provinsi. Sementara itu dari Dinas ESDM Provinsi Jawa Timur memaparkan bahwa dengan ditetapkannya Undang-Undang Nomor 23 Tahun 2004 tentang Pemerintahan Daerah, Pemerintah Daerah Provinsi Jawa Timur diberikan tambahan kewenangan dibidang energi dan sumber daya mineral untuk menerbitkan perizinan dan/atau rekomendasi perizinan pertambangan, air tanah, energi baru terbarukan dan ketenagalistrikan.
Guna merespon UU dimaksud maka Pemerintah Provinsi Jawa Timur menetapkan Peraturan Gubernur Jawa Timur Nomor 16 Tahun 2015 Tentang Pedoman Pemberian Izin Bidang Energi Dan Sumber Daya Mineral Di Jawa Timur.
Terkait dengan air tanah kewenangan Provinsi dalam penerbitan izin meliputi Izin Pengeboran Air Tanah, Izin Pengambilan Air Tanah, Izin Perpanjangan Pengambilan Air Tanah, Izin Peningkatan Debit Pengambilan Air Tanah dan Izin Perubahan Nama, dan Jenis Pengusahaan/Pemakaian Air Tanah. Permohonan izin dapat diajukan oleh Badan Usaha, Koperasi atau perorangan.
Permohonan sebagaimana dimaksud diajukan dengan surat permohonan yang ditujukan kepada Kepala Badan Penanaman Modal Provinsi Jawa Timur selaku Administrator UPT P2T.
Surat permohonan izin dilampiri dengan kelengkapan dokumen yang dipersyaratkan dan diajukan sesuai mekanisme yang telah ditentukan. Berdasarkan permohonan apabila semua mekanisme permohonan dan persyaratan telah dipenuhi, maka dilakukan proses penerbitan Izin dan/atau penerbitan rekomendasi.
